Terms of Service

This is a pre-launch version, published ahead of any paying customers.

These Terms of Service ("Terms") govern your use of uxtruth.com and the UXTruth application (the "Service"), operated by Bhargav, operating as UXTruth ("UXTruth," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm you meet this requirement.

2. Accounts

You are responsible for maintaining the security of your account and for all activity under it. Notify us immediately at [email protected] if you suspect unauthorized access.

3. The Service

UXTruth provides AI assisted UX research tools, including identifying and scoring target user segments (Discover), generating research plans and interview guides (Plan), and processing interview recordings into insights, patterns, and client-ready reports (Synthesise). Features described as upcoming or in development are not part of the current Service until released.

The Service is provided as is, and features, limits, and pricing may change as the product develops. Material changes to paid plan features will be communicated in advance.

4. Plans, billing, and trial

New accounts receive a 7 day free trial with limited usage across Discover, Plan, and Synthesise, as described on our pricing page. The trial ends when the 7 days elapse or when its usage limits are reached, whichever happens first.

Paid plans are billed in advance on a recurring basis through our payment processor. By subscribing, you authorize recurring charges until you cancel.

You may cancel at any time from your account settings. Cancellation stops future billing but does not refund the current billing period; you retain full access to your paid plan until the end of the period you already paid for.

Fees are non-refundable except where required by law or expressly stated otherwise.

We reserve the right to change pricing for future billing periods, with notice provided in advance.

5. Your content

"Your Content" means anything you input, upload, or submit to the Service, including product descriptions, research questions, and interview recordings, audio, video, or transcripts.

You retain ownership of Your Content. You grant us a limited license to use, process, and store Your Content solely to provide and improve the Service to you, as described in our Privacy Policy.

You are responsible for having the right to submit Your Content, including any interview recordings or transcripts containing information about other people.

If you use Synthesise, you confirm that you have obtained appropriate consent from each interview participant before uploading their recording, audio, video, or transcript to the Service, and that your collection and use of their information complies with applicable law. UXTruth processes this content on your behalf as a data processor; you remain the data controller responsible for the underlying participant relationship. You agree to indemnify us against any claim arising from your failure to obtain such consent.

7. Generated outputs

Outputs generated by the Service from Your Content, including research plans, interview guides, screener surveys, segment scores, insights, patterns, personas, empathy maps, and reports ("Outputs"), belong to you. You may use Outputs for any lawful purpose, including client deliverables and commercial work.

Because Outputs are generated by AI, we do not guarantee their accuracy, completeness, or fitness for any particular purpose. You are responsible for reviewing Outputs before relying on them or presenting them to clients or stakeholders.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any person's rights.
  • Upload content you do not have the right to submit, including recordings made without participant consent.
  • Attempt to reverse engineer, scrape, or extract the Service's underlying models, prompts, or knowledge base.
  • Interfere with or disrupt the Service's infrastructure or attempt unauthorized access to any account other than your own.
  • Use the Service to build a directly competing product.

We may suspend or terminate accounts that violate this section.

9. Intellectual property

The Service, including its software, design, and underlying research methodology knowledge base, is owned by UXTruth and protected by applicable intellectual property law. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as intended.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that AI generated Outputs will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, UXTruth is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or discontinue the Service with reasonable notice. On termination, Section 6 (indemnification), Section 9 (intellectual property), 10, 11, and 13 survive.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to these Terms

We may update these Terms as the product evolves. Material changes will be notified via email or a notice on the Service. Continued use after a change constitutes acceptance of the updated Terms.
